The Waste Management (Registration of Brokers and Dealers) Regulations 2008
The Minister for the Environment, Heritage and Local Government, has introduced regulations to tighten controls on the export of waste abroad for recycling and recovery.
A large proportion of Irish waste is exported for recycling and recovery. The movement of waste needs to be policed and controlled to prevent illegal waste activity. The registration system will assist with the provision of information on the export of Irish waste collected for recycling or recovery.
These Regulations provide a registration system for waste brokers and dealers and will facilitate controls on those who arrange shipments of waste. The system will be administered by Dublin City Council and will allow the Council to certify those involved in the business but also to remove those found to have breached the rules.
The Regulations have been designed to keep down the administrative burden placed on the industry. Dublin City Council will carry out the role as Reistration Authority for the whole country. They will place controls on the shipments of waste to ensure that waste is moved without harm to our environment.
The Waste Management (Registration of Brokers and Dealers) Regulations 2008 will come into effect on 1 July 2008. These amend several Acts and regulations. One such amendment is the definitions of “holder of waste†in the Waste Management Act 1996 as amended; another is the definition of “environmental pollution†by deleting the words “to a significant extentâ€.
The Regulations define a “broker†as any person arranging the recovery or disposal of waste on behalf of others and includes those brokers who do not take physical possession of the waste.
Any person who arranges the shipment of waste the subject of the TFS Regulation, these Regulations or the Waste Management (Shipments of Waste) Regulations 2007 (S.I. No. 419 of 2007) or who facilitates the movement or transfer of waste within the State is required to make such arrangements or facilitate such movements or transfers of waste with only those brokers or dealers have a valid certificate of registration.
